MusicGym Terms of Service

1. Who we are

MusicGym is provided by Austris Music (“MusicGym”, “we”, “us”).

2. Acceptance of terms

By creating an account, installing, accessing, or using MusicGym, you agree to these Terms and acknowledge the MusicGym Privacy Policy.

If you do not agree, do not use the app.

3. The service

MusicGym provides practice tools for musicians, including:

  • interactive exercises and routines,

  • tuning and pitch feedback,

  • progress tracking (including XP, streaks, and levels),

  • teacher/student learning tools where available,

  • optional AI coaching (“Nemo”).

MusicGym is an educational tool and does not guarantee learning outcomes.

4. Accounts, roles, and access

4.1 Account responsibility

You are responsible for:

  • keeping your login credentials secure,

  • using the app lawfully,

  • ensuring any information you provide is accurate,

  • keeping your parent/guardian verification information accurate where applicable.

4.2 Roles

MusicGym may offer different roles, such as student, teacher, and administrator. Access to some features depends on the role assigned to the account.

4.3 Age and parent-managed accounts

MusicGym accounts are intended for users aged 16 or older unless a parent or legal guardian creates and manages the account for a child under 16.

If an account is used for a child under 16:

  • the parent or legal guardian must create or manage the account where required by law;

  • MusicGym may require parent verification before full access is granted;

  • MusicGym may pause, block, or limit access while parent verification is pending or under administrator review;

  • the parent or legal guardian is responsible for the child account where required by law.

5. Rules of use (acceptable use)

You agree not to:

  • misuse the service, attempt to access another person’s account, or probe security;

  • send, submit, or share illegal, infringing, abusive, or unlawful content through prompts, messages, notes, or any future content tools;

  • reverse engineer or attempt to extract proprietary logic beyond what is permitted by law;

  • disrupt the service (for example, automated scraping or denial-of-service activity);

  • use MusicGym to create harmful or unlawful content;

  • attempt to export or access data belonging to another user.

The consumer app does not currently provide a general user file upload feature. If that changes later, the same acceptable-use rules will apply to those features.

We may suspend or terminate accounts for violations.

6. AI assistant ( “Nemo”)

6.1 What Nemo does

Nemo can:

  • explain feedback summaries,

  • suggest practice strategies,

  • help you navigate app features,

  • propose exercise adjustments.

6.2 No professional advice

Nemo’s output is generated by a model and may be incorrect. Nemo does not provide medical, therapeutic, legal, or safety-critical advice.

6.3 Use at your own risk

You remain responsible for how you apply coaching suggestions, including how you practice and how long you practice.

6.4 Your inputs

You are responsible for the prompts, messages, and other content you submit to Nemo. Do not submit content you are not allowed to share.

7. Levels and progression rules

MusicGym may restrict access to certain exercises based on your level in order to support safe progression.

XP, progression rules, unlock rules, and related balancing may change over time as we improve the product.

8. Paid features (if applicable)

If you offer subscriptions or in-app purchases:

  • prices and billing terms are shown in the relevant app store;

  • payments are handled by the app store, and its terms also apply;

  • refunds follow the app store’s policies unless local consumer law requires otherwise.

9. Availability and changes

We may modify, update, or discontinue features. We try to keep the service available, but we do not guarantee uninterrupted or error-free operation.

10. Intellectual property

MusicGym and its software, designs, branding, and content are protected by intellectual property laws.

Except where allowed by law, you may not copy, modify, distribute, or create derivative works from MusicGym without permission.

11. Termination and suspension

You may stop using MusicGym at any time.

We may suspend, restrict, or terminate your account if:

  • you violate these Terms,

  • parent verification is incomplete or disputed for an under-16 parent-managed account,

  • administrator review determines that access should not continue,

  • suspension is required for security, abuse prevention, or legal reasons.

12. Disclaimers

MusicGym is provided “as is” and “as available”.

To the maximum extent permitted by law:

  • we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement;

  • we are not responsible for third-party services such as app stores or external sign-in providers;

  • you remain responsible for safe practice habits and for how you use the app’s feedback and AI suggestions.

13. Limitation of liability

To the maximum extent permitted by law, MusicGym’s total liability for any claim is limited to:

  • the amount you paid in the past 12 months, or

  • EUR 50,

whichever is greater.

This does not exclude liability that cannot be limited under applicable law.

14. Privacy, data export, and account deletion

Our Privacy Policy explains how we process personal data.

MusicGym may provide in-app tools that allow a signed-in user to:

  • export that user’s own private data,

  • delete that user’s own account,

  • manage AI privacy settings and related privacy preferences.

You may only use these tools for your own account or for an account you are legally authorized to manage, such as a parent-managed child account where applicable.

If you delete your account, access to the service ends for that account and related data handling is governed by the Privacy Policy and applicable law.

15. Governing law and disputes

These Terms are governed by the laws of The Netherlands, unless mandatory consumer law in your country requires otherwise.

Disputes should be brought to the courts in Amersfoort, unless mandatory law requires otherwise.
